How the New Buyer Agency Agreement Works

If you’ve started looking at homes recently, you may have noticed something new: agents now ask buyers to sign an agreement before touring homes. This is not a trick or a sales tactic. It’s a new industry rule, and it’s actually meant to protect you.

The agreement spells out three simple things: how long your agent will work for you, what services they’ll provide, and exactly how they get paid. In the past, a lot of this was assumed or hidden in the fine print. Now it’s written down in plain language before you even step inside a house.

The most important question to ask before you sign is simple: “Can you walk me through exactly how you get paid, and who pays you?” Sometimes the seller still covers your agent’s fee, but that’s negotiated case by case now instead of being automatic. A good agent will explain this clearly, without making you feel rushed.
